1. Acceptance of Terms

By creating an account or using the Platform in any way, you confirm that you are at least 18 years old, that you have read and understood these Terms, and that you agree to be bound by them. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Platform Description

Curafyn is a free online classifieds platform for medical equipment, healthcare supplies, and healthcare recruiting. We provide a venue where users can post listings and connect with one another. Curafyn does not buy, sell, own, or transfer any medical equipment. We do not employ or recruit healthcare professionals. We are a platform that facilitates connections between users.

The Platform is provided free of charge. We do not charge listing fees, transaction fees, or subscription fees. We reserve the right to introduce paid features in the future, but existing free features will remain free.

3. User Accounts

To post listings or access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must notify us immediately at legal@curafyn.com if you suspect unauthorized access to your account.

4. Listings and User Content

Users are solely responsible for the accuracy, completeness, and legality of their listings. When you post a listing, you represent and warrant that:

• All information in the listing is accurate and not misleading.
• You have the legal right to sell, transfer, or offer the item or service described.
• The listing does not violate any applicable law, regulation, or third-party right.
• Any stated condition of equipment is truthful and based on your honest assessment.

Curafyn does not verify listings. We do not inspect, test, or independently verify the condition, authenticity, safety, or legality of any listed item or service. All information about equipment condition, specifications, and functionality is seller-reported. Buyers should conduct their own due diligence, including independent inspection, before completing any transaction.

5. Medical Equipment and Regulatory Compliance

Medical equipment and devices listed on the Platform may be subject to federal, state, and local regulations, including regulations enforced by the U.S. Food and Drug Administration (FDA). Users are solely responsible for understanding and complying with all applicable regulations governing the sale, purchase, transfer, and use of medical equipment and devices in their jurisdiction.

Without limiting the foregoing, users must:

• Ensure that any medical device they list is legally permitted for resale or transfer.
• Comply with FDA requirements for device registration, labeling, and reporting, where applicable.
• Not list recalled devices unless the listing clearly discloses the recall status.
• Comply with all state licensing requirements for medical device dealers or distributors.

Curafyn does not provide guidance on regulatory compliance and is not responsible for any legal consequences arising from non-compliant listings or transactions.

6. No Medical Advice

Nothing on the Platform constitutes medical advice, diagnosis, or treatment recommendations. The Platform is a classifieds service, not a healthcare provider. Always consult a qualified healthcare professional for medical decisions. Curafyn is not responsible for any health outcomes resulting from equipment purchased or services found through the Platform.

7. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent listings.
• List controlled substances, prescription drugs, or items that are illegal to sell in your jurisdiction.
• Use the Platform for any unlawful purpose or in violation of any applicable law.
• Harass, threaten, or abuse other users.
• Scrape, crawl, or use automated means to access the Platform without our written permission.
• Interfere with the security or proper functioning of the Platform.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Post spam or irrelevant content.

8. User-Generated Content

You retain ownership of content you post on the Platform. By posting content, you grant Curafyn a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely in connection with operating and improving the Platform. This license ends when you delete your content or your account, except that copies may persist in backups for a reasonable period.

We reserve the right to remove any content that violates these Terms or that we find objectionable, at our sole discretion and without notice. We are not obligated to monitor user content but may do so.

9. Healthcare Recruiting

Job listings and recruiting posts on the Platform are posted by third-party employers and recruiters. Curafyn does not screen, verify, or endorse any job listing, employer, or candidate. Users are responsible for verifying the legitimacy of job postings and the qualifications of candidates independently.

10. Account Termination

You may delete your account at any time. We may suspend or terminate your account at our sole discretion, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Platform ceases immediately, and we may delete your account data and listings.

11. Disclaimers and No Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Platform will be uninterrupted, secure, or error-free. We do not warrant the accuracy, reliability, or completeness of any listing, content, or information on the Platform. We make no warranty regarding any transaction between users.

12. Limitation of Liability

To the maximum extent permitted by law, Curafyn and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Platform, regardless of the theory of liability.

Our total aggregate liability for any claims arising under these Terms or related to the Platform shall not exceed one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

13. Indemnification

You agree to indemnify, defend, and hold harmless Curafyn and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your listings, your violation of these Terms, or your violation of any law or third-party right.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Effective Date” at the top of this page and, where practical, notify you via email or a notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
